Agreed Dismissal Order – Illinois Court
The Agreed Dismissal Order form is used in the Illinois Circuit Court to document the dismissal of an eviction case, which may be reinstated if the defendants violate the terms of the agreement.
This guide will help you complete the Agreed Dismissal Order form required by the Illinois Circuit Court.
Top Section
- County: Enter the name of the county where the case was filed.
- Plaintiff: Enter the full name(s) of the plaintiff(s) (e.g., landlord or owner).
- Defendants: Enter the full name(s) of the defendant(s) (e.g., tenants or occupants). If the “Unknown Occupants” box was checked on the Eviction Complaint, check this box as well.
- Case Number: Enter the case number as listed on the Eviction Complaint.
Section 1: Court Appearance Reason
- Check all that apply:
- Trial
- Hearing on Motion
- Status
- Other: Specify the reason.
Section 2: Attendance
- Check all that apply:
- Plaintiff
- Plaintiff’s Lawyer
- Defendants: Specify names if more than one.
- Defendants’ Lawyer
- Other: Specify names.
Section 3: Payment Agreement (if applicable)
- If defendants will pay an agreed amount, enter the total amount for past dues, rent, assessments, court costs, etc.
- Specify the payment schedule:
- Option a: Enter the amount, frequency (monthly, every two weeks, or every week), and start and end dates.
- Option b: Enter the total amount and the due date.
Section 4: Defendants’ Status
- If defendants are staying in the unit, they must pay any listed amounts plus future rent/assessments as due.
Section 5: Move Out Agreement (if applicable)
- If defendants must move out, enter the move-out date and time.
- Check all that apply:
- Return keys to Plaintiff: Specify date and time.
- Notify Plaintiff of move-out: Provide phone number or email.
Section 6: Conditions for Case Reinstatement
- Check all that apply to allow Plaintiff to file a motion to reinstate the case if the defendants:
- Violate the repayment agreement in Section 3.
- Do not move out by the date in Section 5.
- Materially violate the lease after this Order and before the date in Section 7.
- Other: Specify.
Section 7: Reinstatement Motion Deadline
- Enter the final date by which the Plaintiff may file a motion to reinstate the case.
Section 8: Consequences of Violations
- Eviction Order: Check if the court will enter an Eviction Order and specify enforcement:
- Immediately
- After a specified number of days
- Money Judgment: Check if the court will enter a money judgment against defendants if they do not pay the agreed amount. Specify the agreed amount minus payments made and other dues as applicable.
Section 9: Other Agreed Terms (if applicable)
- Enter any additional terms agreed upon by the parties.
Section 10: Sealing the Court File
- If both parties agree, check the box to request the judge to remove the eviction court file from the public record. Note that the judge will make the final decision.
Sections 11 and 12: Judge’s Findings and Orders
- Do not fill out these sections. They will be completed by the judge.

- Signatures of Agreement: All parties or their lawyers who agree to this Order should sign.
- Contact Information: Enter the name, address, telephone number, email, and attorney number (if any) of the person completing this Order.
Final Steps
- Ensure all sections are filled out accurately.
- Submit the form as instructed by the court.
The Agreed Dismissal Order form must be accepted by the Illinois Circuit Court as it is approved by the Illinois Supreme Court.
