We refer to these as “site(s),” “service(s),” or “our sites and services.”

The following Privacy Policy (“Policy”) summarizes the various ways that RunSensible.com uses the information you provide to us or we gather from you while you access or use the website at RunSensible.com (the “Site”), our mobile applications (“App”), and our related sites and online services (collectively, the “Services”). It is our goal to provide you with information that is tailored to your individual needs and, at the same time, respect your privacy.

This Policy applies solely to information collected by us through the Services and does not apply to any third-party activities, including third-party websites linked from our Services, third-party social networking platforms or features we make available through our Services, or third-party ads displayed on our Services. We are not responsible for the privacy practices or content of such third parties. We encourage you to read the privacy statements of those third parties.

Account Registration

We require customers who register to use the services offered on our site to give us contact information, such as their name, company name, address, phone number, and email address, and financial qualification and billing information, such as billing name and address, credit card number, and the number of users within the organization that will be using the services.

1. Personal Information that You Provide to Us

Personal information refers to any data that can be used to identify, locate, or contact an individual and any other information linked to personal data. When you interact with our websites and services, we may collect your personal information directly, depending on the specific site or service.

  1. Account or Registration Information where needed to use our sites and services, and may include your name, address, email address, telephone number, birthday, user account name, and password;
  2. Contact Information, which generally includes your name, addresses, email addresses, social media website user account names, and/or telephone numbers;
  3. Payment Information where needed to process payments and generally includes your credit or debit card number, expiration date, and card verification number;
  4. Personal Profile or Service Information, which may include areas of interest, information from social media interactions (such as Facebook, Twitter, or Google+), preferences, physical characteristics (such as height, weight), photographs and, biographical, health information and/or demographic information (such as gender);
  5. Transaction Information, which may include information about how you interact with and use our sites and services, email, other communications, and applications, and how you interact with merchants, business partners, and service providers;
  6. Geographic Location Information but only if your device transmits location data and/or your IP address and you have activated a location-enabled site or service;
  7. Job-Search-Related Information where needed for recruitment purposes and may include educational and employment background, driver’s license number, and social security number;
  8. Survey Data where needed for the functionality of certain services and generally includes survey questions and responses, and may allow you to import email addresses and names in order to send surveys or to allow us to send surveys on your behalf;
  9. Medical Information, where needed for the functionality of certain services, such as to connect you with your healthcare provider, may include your medical history, present symptoms, future conditions or treatments, insurance carrier and plan, and any other medical and health information you or your healthcare provider choose to provide to us;
  10. Appointment Information, where needed to schedule an appointment or consultation through our online appointment or consultation services and may include the requested appointment information, which may be linked with health or legal information that you choose to provide to us;
  11. Access to Your Data, but only if you use certain services, interactive tools, or authorize us to retrieve information from another database, user, or other third party on your behalf, such as integrating a practice management system with your services;
  12. Your Submissions, which generally include information you voluntarily provide through free-form text boxes, forums, document upload, or data retrieval or import;

At the time you express interest in attaining additional information, or when you register for the service, we may also ask for additional personal information, such as title, department name, fax number, or additional company information, such as annual revenues, number of employees, or industry. Customers can opt out of providing this additional information by not entering it when asked. Customers can update or remove their personal information anytime by logging into the Website and editing their Personal Information within the “Settings.” Customers can view their updated profiles to confirm their edits have been made.

2. Information We Automatically Collect About Visits and Usage

For all Site visitors or App users, not just registered users, we collect information such as IP address, device identifier, browser type, device type, domain name, access times, duration of visit, referring URL, platform, new and repeat information, timestamp, exit page information, and other information about how you use the Service. We use analytics, including analytics conducted by third-party services, to help analyze how users use the Services. To do this, our third-party service providers and we use cookies (unique identifiers sent to your computer by a Web server and stored on your computer’s hard drive) and scripts to collect and store information such as how users interact with our Services, errors users encounter when using our Services, device identifiers, how often and for how long users visit and use the Services, which pages they visit on our Services, whether they act on or open emails, and what other sites they used before coming to the Site. We use this information to enhance our site and your user experience. For example, we remember you when you return and log in, reduce your login time, and track which of our web pages are visited and which services are used most frequently.

3. Email Auto-Import

You may associate your email accounts with the Service by providing us with login credentials for your email accounts. Once you have authorized us to do so by associating your accounts, we will use our automated technology to regularly review the contents of emails in your email accounts to look for receipts and transaction-related emails, including those with information about product shipping confirmations reward-program statements, and retail marketing offers. This information collected from your emails will be added to your RunSensible.com account so that you may automatically access this information on the Service and so that we do not use this information for other purposes described in this Policy.

4. Location Data

We may collect precise geolocation data through our Services. RunSensible.com requires this information to enhance your user experience by providing you with location-based offers or opportunities. This geolocation data will be used as outlined in this Policy to tailor our services to your specific needs and preferences.

How We Use Your Information

Personal Information that You Provide to Us

Except as we explicitly state at the time we request information, or as provided for in the RunSensile.com Terms of Service, we do not disclose to any third party the information provided. All financial and billing information we collect through the site is used solely to check the qualifications of prospective customers and to bill for services.

We may use the personal information that you provide in one or more of the following ways:

  1. to carry out our obligations arising from your purchase of, or subscription to, our services or any other contract entered into between you and us;

  13. to administer surveys, sweepstakes, giveaways, contests, or similar promotions or events sponsored by us or our partners;
  14. to prevent fraud or potentially illegal activities, enforce our site’s Terms of Use, or to comply with applicable law;
  15. to allow you to apply for a job or sign up for special offers from third parties through our sites and services;
  16. to help you contact or schedule an appointment with a legal professional listed in one of our directories and to remind you of upcoming or follow-up appointments;
  17. to run (or authorize third parties to run) statistical research on individual or aggregate trends.

Communicate with You

In addition to the uses described in this policy, we may use personal information about you to create and manage your transaction histories and your purchase receipts, send you marketing messages about our Services, and otherwise provide you with and improve the Services. We also use the information that we gather to personalize and customize experience, content, marketing, and recommendations across all our Services, including to target content on our Services to more closely match your interests and, if you have selected to receive email communication from us, target email marketing messages that are more appropriate to your needs.

To Improve Services and Develop New Services

We will use your information to personalize or customize your experience and the Service, develop new features or services, and improve the overall quality of RunSensible.com Services.

Customer Service and Technical Support

We may use your name, address, phone number, email address, how you interact with our Services, and information about your computer configuration to resolve questions you may have about our Services and to follow up with you about your experience.  We also offer various Internet chat services, such as speaking with a RunSensible.com support representative or tax advisor.  Internet Chat transmissions are not encrypted and you should not supply more Personal Information.  A session transcript is retained to resolve questions or issues related to our Services.

In addition to the uses described above, we may utilize personal information that we collect for other purposes, which will be disclosed to you at the time we collect the information or with your consent.

Sharing Personal and Non-Personal Information

From time to time, we may need to share your Personal Information with third parties in the following circumstances:

  1. When we engage third parties to perform services on our behalf, such services include maintenance, hosting, data storage, security, analytics and data analysis, payment processing, marketing, email and text message distribution, customer service, and surveys and sweepstakes;
  2. Third-Party Service Providers: We may share your information, including Personal Information and Usage Data, with third-party service providers who perform various functions to enable us to provide our Services and help us operate our business, such as fraud detection, and prevention, customer care, or performing analytics. Our contracts with these third parties require them to maintain the confidentiality of the Personal Information we provide to them, only act on our behalf and under our instructions, and not use Personal Information for purposes other than the product or service they’re providing to us or on our behalf.
  3. When you schedule an appointment with a legal professional, we may share your contact data, with such healthcare provider or legal professional;
  4. Response to Legal Requests: We may share your information with courts, law enforcement agencies, or other government bodies when we have a good faith belief we’re required or permitted to do so by law, including to meet national security or law enforcement requirements, to protect our company, or to respond to a court order, subpoena, search warrant, or other law enforcement request.
  5. Protection of RunSensible.com and Others: We may share account information, Personal Information, and Usage Data when we believe it is appropriate to enforce or apply our products’ Terms of Service and other agreements or protect the rights, property, or safety of RunSensible.com, our Services, our users, or others.  This includes exchanging information with other companies and organizations for fraud protection and credit risk reduction.  This does not include selling, renting, sharing, or otherwise disclosing the Personal Information of our customers for commercial purposes in violation of the commitments set forth in this Privacy Statement.
  6. Reporting to Credit Bureaus: We may share your information with credit bureaus, consumer reporting agencies, and card associations.  Late payments, missed payments, or other defaults on your account may be reflected in your credit report and consumer report.  We may also share your information with other companies, lawyers, credit bureaus, agents, government agencies, and card associations in connection with issues related to fraud, credit, or debt collection.
  7. We Use Analytics: We use data for analytics and measurement to understand how our Services are used. If a user elects to use our referral service for informing a friend about our site, we ask them for the friend’s name and email address. RunSensible.com will automatically send the friend a one-time email inviting them to visit the site. RunSensible.com does not store this information.
  8. Google Data Policy: RunSensible use and transfer to any other app of information received from Google APIs will adhere to Google API Services User Data Policy, including the Limited Use requirements.
  9. In the event of a merger, acquisition, debt financing, restructuring, sale of Internet Brands’ assets by or with another company, or a similar corporate transaction, we may need to disclose and transfer all information about you, including personal information, to the successor company;
  10. RunSensible is committed to protecting your privacy and ensuring ethical data use. We explicitly affirm that data accessed via Google Workspace APIs is never used to develop, improve, or train generalized AI or machine learning models. This data is accessed solely to provide requested features such as document management, calendar integration, and task synchronization, in strict compliance with data protection laws and Google’s API Services User Data Policy. We process this information securely, with no unauthorized sharing or usage beyond its intended purpose. RunSensible prioritizes transparency and safeguards your data to uphold the highest standards of privacy and security.

User Generated Content, Online Communities and Forums, Profiles, Surveys, Reviews and Ratings

You may choose to publicly disclose personal information about yourself and others in the course of (i) contributing user-generated content (such as articles, blogs, surveys, reviews, ratings, or podcasts), (ii) communicating with others in our online forums, communities, or chat rooms, (iii) creating user profiles for public view, or (iv) posting images, photos, or videos. Please be aware that any information you voluntarily disclose in these areas of our sites or services is unencrypted and public, and therefore, there can be no expectation of privacy or confidentiality, except where the terms of use of the site or service specifically limit the use of the content (for example, we may inform you how survey and rating responses will be used and if anonymity is an option). Any personal information you submit in the course of interacting in these public activities can be read, collected, or used by other users. Before posting in these areas, we encourage you to read the specific site’s or service’s terms of use. We are not responsible for the personal information you choose to make public in these areas and strongly recommend against sharing any personal health or other sensitive information that could directly or indirectly be traced to any individual, including yourself.

Accessing and Updating Personal Information

We encourage you to keep your personal information up-to-date and accurate. The methods for accessing, viewing, correcting, and deleting your personal information will vary depending on the specific sites or services you use and their respective features. You have several options available, such as:

  1. To view and update the personal information you provided, return to the webpage on our site where you initially submitted your data and follow the provided instructions.
  2. To correct or update your account information, log into the site or service where you are registered and go to your account settings.
  3. To close your account, you can log into the site or service where you are registered and navigate to your account;
  4. You can also manage certain aspects of information collection and use, including disabling geo-location, by going to your mobile device’s settings and reviewing each application’s permissions.
  5. If you have any questions about your options, please email support@runsensible.com. Protecting your privacy and security is important to us, and we take reasonable steps to verify your identity before granting access to your data.
  6. Please note that certain records and information will be retained for specific purposes such as legal, payment, accounting, technical reasons, dispute resolution, enforcing our Terms of Service, or customer service. If you have posted comments or user-generated content on our site, we may be unable to delete it. Additionally, we do not take responsibility for removing or editing your public activities or any submissions or content resulting from your public activities. We may reject requests that are unreasonably repetitive, impractical, require disproportionate technical effort, or risk the privacy of others.

Storing Personal Information

We retain your personal information while your account is active or as long as necessary to provide our services. Even after your account is closed, we may retain your personal information if it is reasonably necessary to comply with legal or regulatory obligations, resolve disputes, prevent fraud and abuse, enforce our Terms of Service or any other contracts between us, or if it is not technically feasible to delete your information.

Email and Other Communications

Our sites and services may facilitate communication with you or other users through in-product instant messaging, service-branded emails, SMS, and other electronic channels.

  • Text Messaging

We use text messaging services that allow you to receive and send messages on your mobile phone. We notify users of their tasks, appointments, and other services via text messages.

  • Opting Out of Requested Communications

Requested communications include, for instance, email newsletters and software updates that you may expressly request or that you consent to receive. After you request such communications, you may “opt out” of receiving them by using one of the following methods:

  • Opting Out of Transactional or Relationship Communications

Communications sent by or on behalf of a user are clearly marked as coming from that user. Communications sent by us are marked as being from us or one of our account or support specialists. These communications can be either “real-time” or automatically triggered by specific events or dates, such as appointment reminders. Emails from users and our administrative announcements are typically transactional or related to our relationship, including appointment requests, reminders, and cancellations. While you may not be able to opt-out of certain email messages, our services may allow you to adjust the frequency of receiving them.

Privacy Rights

This section is provided to comply with the requirements of various U.S. data privacy laws and regulations, including the California Consumer Privacy Act (CCPA) and its amendment, the California Privacy Rights Act (CPRA), as well as the Virginia Consumer Data Protection Act (VCDPA) (collectively referred to as “Applicable Data Privacy Laws”). Additionally, this section addresses compliance with the Personal Information Protection and Electronic Documents Act (PIPEDA) of Canada. This section applies exclusively to our users who reside in U.S. states, commonwealths, or territories governed by these Applicable Data Privacy Laws, as well as users in Canada.

Information We Collect

We have collected, or may collect, the following categories of information from our users and/or consumers:

Identifiers: Such as a name, alias, postal address, unique personal identifier, online identifier, IP address, email address, account name, Social Security number, driver’s license number, or other similar identifiers.

Personal Information: As listed under Cal. Civ. Code § 1798.80(e).

Protected Classification Characteristics: Under California or federal law.

Commercial Information: Including records of personal property, products or services purchased, obtained, or considered, or other purchasing or consuming histories or tendencies.

Biometric Information.

Internet or Other Network Activity: Browsing history, search history, and information regarding your interaction with a website, application, or advertisement.

Geolocation Data.

Professional or Employment-Related Information.

Inferences: Drawn from any of the information identified in this section to create a profile about users reflecting preferences, characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, abilities, and aptitudes. Profiles are not used in furtherance of “decisions that produce legal or similarly significant effects,” as defined by the Virginia Consumer Data Protection Act (VCDPA).

Personal information that reveals:

(A) A social security number, driver’s license number, state identification card number, or passport number.

(B) Account log-in details, financial account numbers, debit or credit card numbers in combination with any required security or access codes, passwords, or credentials allowing access to an account.

(C) Precise geolocation data.

(D) Racial or ethnic origin, immigration status, religious or philosophical beliefs, or union membership.

(E) The contents of mail, email, and text messages, except where we are the intended recipient.

(F) Genetic data: The processing of biometric or genetic information to uniquely identify a consumer.

We may collect and store specific categories of sensitive personal information (e.g., account log-in details, precise geolocation) to provide our services to you, for short-term, transient use based on your interactions with our sites, and with your consent.

Use and Disclosure of Personal Information

The personal information outlined in the categories above may be used for the business purposes detailed under “How We Use Your Information.”
